Indonesian Government Sued by PT Tambang Mas Sangihe for IDR 1 Trillion More

The plaintiff asked the court to declare that the defendants had committed an unlawful act.

President Joko Widodo (Jokowi) and the Coordinating Minister for Maritime Affairs and Investment Luhut Binsar Pandjaitan were sued by PT Tambang Mas Sangihe (TMS) for more than IDR 1 trillion.

Citing the South Jakarta District Court SIPP, Thursday (25/8/2022), the lawsuit with case number 772/Pdt.G/2022/PN JKT.SEL was registered on August 23, 2022.

Apart from Jokowi and Luhut, the lawsuit was also addressed to the National Police Chief Listyo Sigit Prabowo, Minister of Law and Human Rights Yasonna H. Laoly, Komnas HAM, Regent of Sangihe Islands, Mardi Posumah, Grace Kapal, Sonny Posungulah, and Andri Mailoor.

In the petition filed, the plaintiff asked the court to declare that the defendants had committed an unlawful act. The plaintiff also asked the court to punish the defendants I to v jointly and severally to compensate for the losses.

The plaintiff also asked the judge to sentence Defendants I to V to compensate for material losses amounting to US$ 37 million. Meanwhile, he also asked the judge to sentence Defendant VI, Defendant VII and Defendant IX to compensate for material losses of Rp. 31.9 billion.

The Plaintiff also requested that the judge punish the Defendants jointly and severally to compensate the plaintiff for immaterial losses of Rp. 1 trillion.

PT Tambang Mas Sangihe (TMS) is a joint venture company consisting of four parties. They have a work contract permit for 4,200 hectares in the Sangihe Islands Regency with the license number 163.K/MB.04/DJB/2021.

From this data, it is stated that PT TMS is currently entering the production operation stage with commodities in the form of gold. The permit was obtained by PT TMS from January 29, 2021 to January 28, 2054.

Citing detik.com, PT TMS is 70% owned by Sangihe Gold Corporation, a Canadian mining corporation with offices in Jakarta.

The remaining 30% of ownership is taken by local companies. Details of the distribution, PT Sungai Belayan Sejati 10%, PT Sangihe Prima Mineral 11%, and PT Sangihe Pratama Mineral 9%.

The presence of PT TMS in the Sangihe Islands, North Sulawesi was rejected by many residents. This rejection was also conveyed by the Deputy Regent of Sangihe North Sulawesi Helmud Hontong to the Ministry of Energy and Mineral Resources before he died.
